The Contract Between Us
Any contract for purchases made through the website will be with 77thStreet.com and 77thStreet.com must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.

Once payment has been received, we will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. Our acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

77thStreet.com is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

General Terms
These terms and conditions and all transactions relating to this website are governed by the law of The Republic Of Singapore and are subject to the non–exclusive jurisdiction of the Singapore courts. We do not accept amendments to these terms and conditions.

Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.

These terms and conditions only cover 77thStreet.com website as any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.

Payment Details
We accept payment by Visa, MasterCard, American Express, Switch, Maestro and Delta through Paypal. All product prices and delivery charges are shown in Singapore $. Your payment card company will perform any currency conversion.

Upon receiving your order, 77thStreet.com carries out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfill the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged when you have confirmed the order.

Availability of Goods You Order
If 77thStreet.com has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by us from your credit card will be re-credited to your account and we will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. In any event, 77thStreet.com will not be obliged to offer any additional compensation for disappointment suffered.

Please note: We endeavour to bring to our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and are subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price may take up to a few hours to update.

Changes to This Agreement
77thStreet.com reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

International Shipping Terms and Conditions
We ship to countries around the world. Please read the following terms and conditions carefully to avoid additional charges or delayed delivery of your order.

Product Pricing and Exchange Rates
All prices listed are in GB Sterling £. When you pay by credit card, the credit card company will calculate the exchange rate and include it in your monthly statement.

International Addresses
NOTE: You must provide a street address for shipping. We cannot ship to P.O. Boxes internationally.

International Shipping Fees, Import Duties and Taxes
•    All International shipments will be charged postage costs calculated by weight and destination.
•    Import Taxes: 77thStreet.com’s prices do not include customs fees, taxes and tariffs. You may have to pay import taxes, customs duty, etc. These charges are separate from your shipping charge, and you will be billed directly for them.
•    Customers outside of the Singapore may be subject to customs fees and/or import duties and taxes, which are levied once a shipment reaches your country.
•    You, the customer, are solely responsible for any additional customs clearance fees; we have no control over these charges and cannot predict what they may be.
•    It is your responsibility to make sure that you are allowed to import our products from the Singapore.

International Returns or Packages Refused
•    If the package(s) is returned to us because of an address error made by the customer, the customer refuses the package or the items ordered are not allowed into the country by customs, the customer will be responsible for the shipping cost billed to 77thStreet.com for the return of the package.
•    If the postal return to shipper cost is greater than the cost of the goods ordered, 77thStreet.com will instruct the post to abandon the order, and there will be no credit issued to the customer for the order.
•    If the package is stopped by customs because items ordered are not allowed in the consignee's country and the package is abandoned, there will be no credit issued to the customer for the order.
•    If the package is stopped by customs upon return to the Sinagpore, and the package is abandoned, there will be no credit issued to the customer for the order.

Your Country's Custom and Import Policies
Please note: It is important for you to become familiar with the Customs policies for your specific country before ordering. Customs regulations vary greatly by country and lack of knowledge regarding the customs rules governing the country you're importing to can result in your order incurring high import duties, delivery being delayed, or returned to us. It is your responsibility to check with your Customs office to see if your country permits the shipment of our products.

Additionally, when ordering from 77thStreet.com.com, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Any fees charged to 77thStreet.com.com due to non-compliance with your country's laws and regulations will be charged to you, the importer. If an item or items are returned to us due to non-compliance issues with your country's laws and regulations, a refund will be issued for the merchandise only, minus 20 percent of the value of your order as the re-stocking fee, and any other charges incurred such as quarantine fees, shipping fees or warehousing fees assessed by the customs in your country

Prize Draw and Promotions Terms and Conditions
 
77thStreet.com is responsible for this prize draw and promotions as part of our launch event from 28 March 2011 to 30 April 2011. You can participate in the prize draw or promotion only if you agree to and accept the following terms and conditions without limitation or reservation.
 
You may download information displayed here for your non-commercial, personal use only. 77thStreet.com reserves the right to cancel or amend the prize draw/promotions/terms and conditions periodically without any prior notice.
 
Qualifying Entrants
1. The Prize Draw is open to everyone who subscribes to our newsletter, joins our Facebook group (or is a current fan), follow us on Twitter or make a purchase on 77thStreet.com. If you do not wish to enter, please email us on customer.support@77thStreet.com and we will take you out of the prize draw.
2. Employees of 77th Street (S) Pte Ltd or any related companies, their advertising and promotion agencies and their immediate family members and/or those living in the same household of each are not eligible.
 
Deal of the Day
1.    We will have a different deal of the day through the length of our promotion
2.    Each product is limited in quality, when its gone, its gone!
3.    These are limited to one item per customer per day.
4.    If you try to purchase more than one, we will reduce your order to only one.
 
Prize Draw
1. The prize draw is valid from 28 March 2011 to 30 April 2011. The daily promotions will take place during this period,
2. Representatives of 77thStreet.com will pick the winning entry or entries amongst all eligible entries as the winner and the decision is final and binding. No correspondence will be entertained about the contest/promotion result. The closing date is midnight 30 April 2011.
3. The winner/winners may be required to participate in public relations events tied to the contest to generate press coverage of the contest and the accessories range. This may include, but not be limited to, quotes given for inclusion in press releases and press conferences, interviews, etc.  
4. 77thStreet.com reserves the right to disqualify all entries that do not meet the rules and regulations of the contest/promotion. These include entries submitted with invalid or incorrect information.
 
Prizes
1. Prizes are non-transferable and non-exchangeable for cash and may be subject to availability. Value of the prizes may vary which 77thStreet.com reserves the right to replace any prizes with items of similar value without prior notice.
2. Acceptance of any prize shall constitute consent on the winner's part to allow the use of the winner's name, image, voice and/or likeness by 77thStreet.com for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.
3. The winner of the contest will be announced on www.77thStreet.com  and a prize notification email will be sent to the winner/winners.
4. 77thStreet.com reserves the right to deal with all unclaimed prizes in any manner deemed fit.
5. The winner/winners must produce proof of identity and the printed prize notification email upon the prize collection.
6. By entering the contest/promotion or accepting the prizes, you agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against 77thStreet.com, its related companies, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from the contest/promotion and acceptance of any prize, including without limitation, personal injuries, death and property damage.
 
Use of Personal Information
1. By entering the prize draw, you agree to the use of your name and/or likeness, without compensation, for 77thStreet.com promotional and marketing purposes and to the use of the information submitted on the contest/promotional entry form, without compensation, for 77thStreet.com's promotional and marketing purposes.
